Welcome to the AI Voice Journal app, developed and operated by Ye & Zheng Innovations, LLC ("Company", "we", "us"). These Terms of Service ("Terms") govern your use of the AI Voice Journal app and related services ("Services"). By using our Services, you agree to be bound by these Terms. If you do not agree, please discontinue use.

1.Acknowledgement: You acknowledge that the agreement is between you and Ye & Zheng Innovations, LLC only, and not with Apple. The Company, not Apple, is solely responsible for the Licensed Application and its content. The usage rules for the Licensed Application are consistent with the Apple Media Services Terms and Conditions.

2.Scope of License: The license granted to you is a non-transferable license to use the AI Voice Journal app on Apple-branded products you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.

3.Maintenance and Support: Ye & Zheng Innovations, LLC is solely responsible for providing maintenance and support for the app, as specified in these Terms or as required by applicable law. Apple has no obligation to furnish any maintenance and support services.

4.Warranty: Ye & Zheng Innovations, LLC is solely responsible for any product warranties, to the extent not effectively disclaimed. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the app to you; to the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the app.

5.Product Claims: Ye & Zheng Innovations, LLC, not Apple, is responsible for addressing any claims by you or any third party relating to the app or your possession and use of the app, including: (i) product liability claims; (ii) any claim the app fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection or similar legislation.

6.Intellectual Property Rights: In the event of a third-party claim that the app or your possession and use of the app infringes on third party intellectual property rights, Ye & Zheng Innovations, LLC, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.

7.Legal Compliance: You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a “terrorist supporting” country, and you are not listed on any U.S. Government list of prohibited or restricted parties.

9.Third-Party Terms of Agreement: You must comply with applicable third-party terms of agreement when using the AI Voice Journal app.

10.Third-Party Beneficiary: You and Ye & Zheng Innovations, LLC acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms, and that, upon your acceptance of these Terms, Apple will have the right to enforce these Terms against you as a third-party beneficiary thereof.
